Maori welcome new patent legislation

Updated patent laws will better protect Maori culture and traditions, Maori lawyers told MPs yesterday.

Parliament's commerce select committee is considering the Patents Bill, drafted to update 50-year-old legislation.

Maori Law Society president Damian Stone told the committee yesterday that cultural intellectual property needed to be recognised.

"We don't see this as any special favour to Maori -- it's just a new category of knowledge that the intellectual property system hasn't got to just yet," Mr Stone said.

The bill took into account Maori rights under the Treaty of Waitangi, and would bring it into line with international patent and intellectual property laws, he said.

One example he cited was the use of traditional kawakawa plant Maori used in healing for centuries which was being developed for commercial use. It would now be covered under the new patent legislation.

The bill also sets up an advisory committee to communicate with the Commissioner of Patents about Maori patent rights, and speak on behalf of Maori.

The bill coincides with the Wai 262 claim, which seeks comprehensive intellectual property rights to indigenous flora and fauna as well as all Maori cultural knowledge, customs and practices.

The Waitangi Tribunal is investigating the claim.

This legislation abrogates our true treaty. In international law, if there is more than one Treaty and one is in the native language that in the native language takes preceedence over all others. There are no privileges in te Tiriti for Maori that are not available to "all the people of New Zealand."

Governments Official English Treaty was writen by a Mr James Freeman, one who had no authority to write our treaty. It is false.

The "Principles of the Treaty of Waitangi" have been used to finalise all recent settled claims and "Principle 3" states, "All New Zealanders are equal before the law." Therefore, if all NZers were not treated equally to settle these claims then I would imagine all such claims would be "null and void."

Patent Prevention or Profiteering

It is the process that you patent not the raw material... After all, you would struggle to evidence that Maori invented the Kawakawa plant... Is the proposal to: A) prevent anyone patenting things that were already known to Maori (already public knowledge), or B) to provide Maori with patent rights on raw materials? There is merit in A), but B) is both ridiculous and offensive.

ive heard that maori are chinese slaves thing before...it was dumb then, and still is. thats a weak argument that has been disproved time and time again by other evidence such as the language, art, religion and technology of our closest neighbors such as rotonga, nuie, samoa, tonga fiji tahiti etc etc etc. were they all dropped off too by the chineese? nah mate... us polys are native to all of these islands and have been in the pacific for thousands of years.

the treaty is a smoke screen for the real issues. the real issue is the declaration of independence 1835. from then on, the settler governments tried to do a swifty on the "dumb" natives. its the greatest crime ever committed in these islands bar none. how did this happen? eggs like you who spread myths designed to try and devalue the maori people. well, it dont work on us. we know who we are and where are going.
