Personal liability in body corporate case

A recent court decision has confirmed body corporate committee members can be made personally liable for their decisions.

The Unit Titles Act changed the law to enable individual owners to hold members of the body corporate committee personally responsible.

AUT Property law lecturer Rod Thomas told NBR NZPI a court case over 101-7 Queen St has opened the door to liability for individual owners.
