Council could be liable for third party certifier in $10 million leaky building case

The High Court at Auckland has given apartment owners in Parnell the green light to pursue a $10 million claim against Auckland Council for weathertightness repairs. 

The case is unique because the council did not sign off on the 211 unit apartment building dubbed “The Landings”, but it was privately certified.

According to a recent High Court judgment the building was inspected by private certifier Compass but that company, which is now in liquidation, appears to have not properly carried out its tasks.
