High Court voids 'meddling' council settlement with leaky homeowners

In an unprecedented case, the High Court at Auckland has voided a settlement agreement between Auckland Council and leaky homeowners.

Justice John Fogarty said in a decision that Auckland Council was “meddling” when it cut a deal with homeowners that assigned the council the rights to sue other parties in a leaky building claim.

The total sum under the leaky building claim for Fleetwood Apartments in central Auckland was in excess of $3 million and included repair costs, a claim for losses on the sale of some units and general damages.
