Skepticism over caps for council negligence

A senior construction lawyer says caps on local councils for negligence are inappropriate and encourage the wrong behavior from officials.

Kensington Swan partner Mary Haggie says while she agrees with the Law Commission’s view on how to treat liability for leaky homes, capping liability doesn’t make sense.

Yesterday the Law Commission recommended caps to help local governments get insurance for potential liability.
