Top judges at odds – how Winkelmann trumped Elias

When three Supreme Court judges decided it was lawful to jail contemptuous website publisher Vince Siemer, one significant voice disagreed.

Chief Justice Dame Sian Elias disagreed strongly with an original decision by her Chief High Court judge Helen Winkelmann to hold Mr Siemer in contempt and order his jailing for breaching a suppression order in the Urewera raids prosecution.

In disagreeing with majority judges the Chief Justice indicated a “general practice” around suppression orders adopted by judges did not seem to meet the requirements of open justice.
