Asahi’s Independent Liquor case delayed

Australian Federal Court Judge Michelle Gordon has set a new trial date in October for Asahi’s $A500 million damages action over its Independent Liquor acquisition in 2011.

As part of the case, Japanese brewer is seeking $NZ150 million against three warranty insurance providers over alleged breaches of warranties given by the sellers, Pacific Equity Partners and Unitas Capital. 

At a hearing last week, one of the insurers, Allied World Assurance, floated an unspecified fraud defence to support a delay as Asahi only joined them as parties to the dispute on April 24.
