Banks’ lawyer says not enough evidence to prosecute; Boag handled return

John Banks’ lawyer today argued at the High Court to throw out charges that allege Mr Banks knowingly signed a false electoral return after a failed Auckland mayoral bid in 2010.

David Jones, QC, applied for Mr Banks to be discharged under section 347 of the Crimes Act 1961 on the grounds there was insufficient evidence to justify a trial.

Justice Ed Wylie heard arguments this morning and reserved his decision.
