Taking shape: Coke's trade mark case against Pepsi may have major repercussions

If The Coca-Cola Co wins its trade mark case against PepsiCo, it could influence infringement thresholds for trade marked shapes.

This week Coca-Cola’s trial began against PepsiCo and its manufacturer, Frucor Beverages, at Auckland’s High Court. It’s part of an international battle to stop the use of PepsiCo’s current soft drink bottles.

Coca-Cola claims the beverage companies are using bottles similiar to its registered contour bottles that it has used for more than a century.
