A company directed by Christchurch property developer David “Hendo” Henderson has been placed into liquidation today on an application by Allied Farmers Investments.
Elgin Investments, which managed and developed the Sydenham Central mall in Christchurch, was placed into receivership earlier this year owing about $18 million.
In the High Court at Auckland this morning Associate Judge Roger Bell appointed the Official Assignee as liquidator of the failed company.
Allied Farmers Investments had previously been awarded a summary judgment of $4.7 million against Elgin.
However, Associate Judge Bell said he wasn’t happy with the “inadequate” filing of Allied’s application.
The initial statement of claim didn’t contain any reference to Elgin and didn’t state the alleged amount of the debt.
It was also filed in the wrong city – although the company is based in Christchurch the office of its receivers KordaMentha is in Auckland.
A certificate of unpaid debt still has to be filed, but the amount of the debt was found in the summary judgment and the report by the receivers.
Inland Revenue was a creditor in support of Allied's application against Elgin.
