Forsyth Barr analyst Guy Hallwright has been discharged of the most serious charge he faces relating to a road rage incident
Mr Hallwright is on trial at Auckland district court, accused of running over Korean motorist Sung Jin Kim after the pair had been involved in a brief altercation before driving off in Mt Eden in September 2010.
Mr Kim broke both legs and shattered an ankle, which required reconstructive surgery.
Mr Hallwright was charged with causing grievous bodily harm with intent to injure, and causing grievous bodily harm with reckless disregard.
He denies both charges.
On day three of the trial yesterday, Judge Raoul Neave told the jury he was discharging Mr Hallwright on the charge of causing grievous bodily harm with intent to injure.
“Given the evidence, and given the fact you are required to draw reasonable inferences, it would not be safe to proceed with count one.”
The jury must now focus solely on Mr Hallwright’s alleged recklessness.
Queen's counsel Paul Davison told the jury Mr Hallwright had no intention of injuring Mr Kim, but simply wanted to get out of a nasty situation.
Mr Hallwright will give evidence when the trial resumes today.
