The kiwifruit stoush between fresh produce company Turners and Growers and exporter Zespri has been delayed until next year.

In July last year, T&G lodged a statement of claim against Zespri claiming it had abused its dominant position for the purpose of preserving its monopoly.

T&G wants to export its own varieties of kiwifruit to the world but is prevented by legislation that requires it to work with Zespri.

The case was originally set down for a five-week High Court hearing in November.

This month the court opted for an initial hearing in July to determine if the kiwifruit export regulations were unlawful and if the court actually has jurisdiction to determine if Zespri was in breach of regulations.

The substantive hearing is set down for a six-week hearing in May, 2011.
