Open Country ‘over-reached’ with statutory demand, says judge
After its customer Wimpex cancelled a big order for A2 milk powder, Open Country sought to recover costs under the contract.
Wimpex backed out of its milk powder deal saying Chinese customers had cancelled their orders.
Milk processor Open Country Dairy, owned by the NBR Lister Talley family, has been ordered to pay additional legal costs to a customer after wrongly issuing a statutory demand for a payment in dispute.
