NZ First MP Andrew Williams will get his day in court after the election.
His case against NZ First for removing him as an electorate and list candidate will be heard in Auckland in November.
Mr Williams, who is being represented by Chen Palmer, wants the High Court to declare the party breached its constitution when it determined its party list.
He was demoted from third to 13th place, then removed all together.
Mr Williams said in a statement that he was given no reason for his demotion.
“The manner in which I have been mistreated by the party has forced me to seek court declarations that the revocation of my electorate and list candidacies, and my removal from the party list, breached the processes in the party’s constitution for fair treatment.
