Todd Petroleum Mining and Shell Petroleum Mining are seeking additional leave to appeal an arbitral award for joint venture exploitation of the Kapuni field in Taranaki.

The arbitration related to a tariff dispute for use of the Whareroa pipeline, which is managed by the Shell Todd Oil Services (STOS) joint venture.

A confidential arbitral award was issued in July last year, with partial leave to appeal granted to both parties by Justice Robert Dobson on 5 March 2010.

According to the March judgment, Todd had sought to use the pipeline to supply gas to a joint venture with Fonterra, leading to a dispute with Shell as to an appropriate tariff to be set by STOS for use of the asset.

Todd has since sought to recall Justice Dobson’s judgment, and a closed court session was held in Wellington yesterday to deal with procedural matters.

Russell McVeigh partner Hamish McIntosh told NBR today that both parties were seeking additional leave to appeal from the arbitral award.

“Yesterday was about just clarifying what had been granted and what hadn’t, and then leave to appeal to the Court of Appeal for those that hadn’t been granted.”

More information about the results of the arbitration will become available when the matter is heard in the High Court, Mr McIntosh said.
