Todd granted appeal on limited issue in Shell case
Todd Petroleum (Mining) Company Ltd has been granted special leave to appeal a question of law on a limited issue in a case against Shell involving their joint venture arrangements for the Kapanui field in Taranaki.

An arbitration award was made in the dispute which both parties sought leave to appeal to the High Court on questions of law. Both parties were granted leave to appeal on two questions of law each but not on others and Todd sought special level to appeal on two questions of law it was declined. One was granted in a decision released today. It related to delivery of product from the joint venture Kapuni field.
The granting of special leave is limited to the issue of whether the High Court correctly determined that Todd's application for leave to appeal was out of time.
If Todd succeeds the issue will go back to the High Court to be considered on merits.
