Chris Carter remains in the Labour Party for now, despite being expelled from the caucus late yesterday, but that is likely to change at the party's next council meeting.
Labour president Andrew Little said the party's leadership was taking the issue one step at a time.
"Now that he has been suspended from caucus and the issue has been referred to the New Zealand Council (of the Labour Party), the council has a scheduled meeting on August 7, so the issue will be considered at that point," he said.
If Mr Carter resigns from Parliament it will force a by-election in his Te Atatu electorate, but if not, and presuming he is expelled from the party, he could remain in Parliament as an independent MP and hold on to his electorate until the next election.
Mr Carter's partner Peter Kaiser is chairman of the Te Atatu electorate committee, which throws another issue into the mix, but Mr Little said that was not immediately relevant.
"I don't think there is an issue with Peter Kaiser at this point, we'll just deal with Chris Carter at the moment."
