Labour has asked Speaker Lockwood Smith to consider whether it is within the rules for a person outside Parliament to "direct" the prime minister on the appointment of portfolios.

MP Trevor Mallard raised the issue in Parliament yesterday, saying it had been reported that new ACT leader Don Brash had indicated to Prime Minister John Key who should hold ministerial warrants.

He was speaking after Dr Brash had announced portfolio changes in the ACT caucus.

"Clearly people can take advice but not instructions and directions," Mr Mallard said.

"The way this has been indicated by way of the media is that there has been a direction from Dr Brash to the prime minister as to who should be in his ministry and that is clearly a breach of privilege."

Dr Smith said he would consider the matter and would respond if he thought there was an issue.
