Former high-flying real estate agent Marnie Adams has plead guilty to misconduct charges. The Real Estate Agents disciplinary tribunal has ordered her licence be suspended for 6 months and fined her $10,000 plus $5,000 costs.
The charge was in relation to acquiring an interest in a property she had listed without obtaining the consent of her vendor clients or informing them of her interest in the property.
Ms Adams said in an email to NBR that she accepted by failing to give notice of financial support, her actions were an error of judgement even though it resulted in the best possible outcome for the vendor and purchaser.
This inadvertently breached a section of the REAA industry client conduct code which she said she sincerely regreted. Ms Adams said she would take her suspension as a chance to recharge her batteries and then return to the industry.
“This decision sends a clear message to the industry that they need to disclose any potential conflict of interest “said Dean Winter, Acting Chief Executive/Registrar of the Real Estate Agents Authority.
“Licensees must disclose any conflict of interest so that all parties involved in a real estate transaction are fully informed and there is transparency of any relationship between the buyer or seller and the licensee.
The intent of the Real Estate Agents Act is to give consumers confidence in real estate agency work and this decision shows that this intent is being upheld”
The Real Estate Agents Authority is a crown entity established by the Real Estate Agents Act 2008, which came into force on 17 November 2009. The Authority is tasked with promoting and protecting
the interests of consumers in transactions relating to real estate and promoting public confidence in the performance of real estate agency work.
